Terms and Conditions

Please read the terms and conditions ("Terms and Conditions") set out below carefully before using ordering any Goods or Services from this Website. By ordering any Goods or Services from this Website, by phone, or by our mobile applications you agree to be bound by these Terms and Conditions.

Section 1: Introduction:

We, LUNCH OR DINNER CORP. own and operate this website (lunchordinner.ca), the related mobile sites and mobile applications, and selected other domains (collectively, the "Sites"). These terms of use (the "Agreement") constitute a contract between you (Partner) and us (LOD) and by accessing and/or using the Sites, you agree to all the terms and conditions of this Agreement. If you do not agree, do not use the Sites. As used in this Agreement, “LUNCH OR DINNER” “LOD,” “we,” “us,” and “our” shall mean LUNCH OR DINNER CORP. and its subsidiaries and affiliates.

 Section 2: Definitions

2.1. "Agreement" is a reference to these Terms and Conditions, the Privacy Policy, any order form and payment instructions provided to you;

2.2. "Privacy Policy" means the policy displayed on our Website which details how we collect and store your personal data;

2.3. "you", "your" and "yours" are references to you the person accessing this Website and ordering food from our Website or from any other channel provided by LOD;

2.4. "we", "us", "our", and "lunch or dinner"  "LOD"  are references to the Lunch or Dinner Corp;

2.5. "Order" is a reference to any food, meal which we may offer from our partner restaurants through our Website and Mobile Apps;

2.6. "Service" or "Services" is a reference to any service which we may supply and which you may request via our Website;

2.7. "Participating Restaurant" is a third party, which has agreed to co-operate with the LOD to prepare and/or deliver the food, meal or Services.

2.8. "Food Delivery" is a reference to perishable goods and to any form of food delivery service, which are provided by our Partner Restaurants and for which our Partner Restaurants take full responsibility to prepare and to deliver; and

2.9. "Website" is a reference to our Website or our mobile applications on which we offer our online food ordering services.

Section 3: Ordering

3.1. When you place an order through our Service, an email thanking you for your order and confirming your order has been received and accepted by the Partner Restaurant (the "Confirmation Email") will be sent to you by us on behalf of the Partner Restaurant. The contract for the supply of any meal you order through us will be between you and the Partner Restaurant and will only be formed when you have been sent the Confirmation Email by us.

All meals are subject to availability. Our Partner Restaurant may offer an alternative for any Meal it cannot provide you with. Please call our Partner Restaurant prior to ordering if you have any food allergy. LOD does not guarantee that any of the Meals sold by our Partner Restaurants are free of allergens.

LOD does not prepare or take responsibility for any products prepared and packaged by our Partner Restaurants. The restaurants available on our Sites operate independently and have entered into agreements with us to provide the food and delivery services available to you on the Sites. The restaurants are required to comply with federal, state and local laws, rules, regulations, and standards pertaining to the preparation, sale and marketing of food, including food preparation and safety and menu disclosure; LOD is not responsible for the restaurants' food preparation or safety and does not verify any restaurant's compliance with applicable laws. In addition, LOD does not guarantee the quality of what the restaurants sell, nor does it guarantee the services provided by the restaurant, including in those cases where the restaurant provides the delivery services. In addition, LOD does not independently verify representations made by restaurants regarding their food, including without limitation any menu- or restaurant-level descriptors or disclosures.

Section 4: Prices and Payment

The price of any meals from our Partner Restaurants menu will be listed on our Website. Prices don’t include HST. Menu prices will vary between our Partner Restaurants. Prices are liable to change at any time without notice, but changes will not affect orders in respect of which you have been presented with the Confirmation Email. Despite our best efforts, it is possible that some of the menu items listed on our Website may be incorrectly priced. The relevant Partner Restaurant will normally verify prices as part of the order process.

Payment for all orders can be made by credit or debit card through our Website and by cash. Once your order has been confirmed your credit or debit card will have been authorized and the amount marked for payment. Payment is made directly to LOD and is subsequently passed on by LOD to the Partner Restaurant. We are authorized by our Partner Restaurants to accept payment on their behalf and payment of the price of any order to us will discharge your obligations to pay such price to the Partner Restaurant.

Section 5: Delivery

5.1. Each restaurant determines its own hours and estimate delivery time. Delivery time quoted at the time of ordering is approximate only and may vary to each location and time. Food will be delivered to the address designated by you at the time of ordering. Please ensure that you have given us a correct email address as this is how we will communicate with you about your Order. Please also ensure that you provide an accurate address and telephone number to ensure that your Meals arrive to the correct location. If you do not open the door or respond to telephonic correspondence within 10 minutes of our delivery drivers physically reaching your address, we reserve the right to leave the premises, and you will be charged for the order. LOD seeks to provide a quality service and will be the first contact in event in there is a problem with your Meal either in regards to food quality or service.

 Section 6: Cancellation

6.1. You have the right to cancel an order within a reasonable time. You must notify the LOD and restaurant immediately if you decide to cancel your order, preferably by phone, and quote your order number. If the restaurant accepts your cancellation, no cancellation fee applies. If the restaurant refuses cancellation, e.g. because preparation of order has been completed and/or order has already been dispatched, it may not be cancelled. You should always contact LOD with any complaint or concern you may have with respect to an order for which you paid online. These unlikely events include delivery of wrong item or missing items.
